Terms of Service Last updated: July 31, 2026 Overview These Terms of Service (the “Terms”) govern your access to and use of this online store, website, and all related content, features, products, and services (collectively, the “Services”). The Services are operated by Schaufert Digital, Horst Dieter Schaufert, trading under the Jacked Rabbit and Schaufert Performance brands (“Schaufert Digital,” “we,” “us,” or “our”). Our online store is powered by Shopify. By visiting, interacting with, or using the Services, or by purchasing a product from us, you agree to these Terms, our Privacy Policy, and our Return & Refund Policy. If you do not agree, you must not use the Services. 1. Eligibility and Accounts You must be at least 18 years old and have the legal capacity to enter into a binding agreement to place an order. By using the Services, you represent that you meet these requirements. You may be asked to provide information including your name, email address, billing information, payment information, and shipping address. You represent that all information you provide is accurate, current, and complete and that you are authorized to provide and use it. You are responsible for safeguarding your account credentials and for activity conducted through your account. You must promptly notify us if you suspect unauthorized access to your account. 2. Products and Product Information We make reasonable efforts to display product descriptions, labels, ingredients, quantities, colors, packaging, and images accurately. However, colors and appearance may vary depending on your screen and device. Packaging or label design may be updated by the manufacturer or fulfillment provider, provided that the product remains materially consistent with the description shown when you placed your order. Product availability, descriptions, prices, and quantities may change without notice. We may discontinue a product or limit quantities available to a customer, household, address, geographic area, or order. You are responsible for reviewing the product description, ingredient list, Supplement Facts or other label information, directions, and warnings before purchasing and using a product. Do not use a product if you are allergic or sensitive to any listed ingredient. 3. Dietary Supplements, Cosmetics, and Health Information Products sold through the Services may include dietary supplements and cosmetic products. Statements regarding dietary supplements have not been evaluated by the United States Food and Drug Administration unless expressly stated otherwise. These products are not intended to diagnose, treat, cure, or prevent any disease. Information provided through the Services is for general informational purposes only and is not medical advice. It is not a substitute for advice, diagnosis, or treatment from a qualified healthcare professional. Use products only as directed on their labels. Consult a qualified healthcare professional before using a dietary supplement, particularly if you are pregnant or nursing, taking medication, have a medical condition, are preparing for surgery, or are under medical supervision. Individual responses and results may vary. Discontinue use and seek appropriate medical advice if you experience an adverse reaction. 4. Orders and Acceptance Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt of your order but does not necessarily constitute acceptance. We accept an order when payment has been successfully processed and the order has been approved for fulfillment. We may decline, limit, or cancel an order when reasonably necessary, including because of suspected fraud, payment problems, pricing or inventory errors, an unavailable product, an unsupported shipping address, suspected resale, or legal or regulatory restrictions. If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method. Orders are intended for personal or household use and not for commercial resale or export. Please review your order carefully before submitting it. Because orders may be sent to fulfillment shortly after acceptance, cancellation or address-change requests cannot be guaranteed. 5. Prices, Taxes, and Payment Unless otherwise stated, prices are displayed in United States dollars (USD). Prices, discounts, and promotions may change without notice. The price charged is the price displayed at the time you submit your order, subject to correction of obvious errors. Applicable sales tax and any permitted shipping charges will be displayed during checkout. A promotion may be subject to additional terms. If promotion-specific terms conflict with these Terms, the promotion-specific terms control for that promotion. You represent that you are authorized to use the payment method submitted with your order and that the payment information is accurate. Payments are processed by Shopify Payments or another payment service displayed at checkout. We do not directly store complete payment-card numbers. 6. Shipping and Delivery We currently accept orders only for eligible delivery addresses within the United States that are available at checkout. Orders are fulfilled and shipped by third-party fulfillment and carrier partners. Processing, shipping, and delivery dates are estimates unless we expressly guarantee a date in writing. We are not responsible for carrier delays, severe weather, service interruptions, incorrect or incomplete addresses supplied by the customer, or other circumstances outside our reasonable control. However, this does not limit rights that cannot legally be excluded. We will ship within the timeframe stated at the time of purchase or, if no timeframe is stated, within the period required by applicable law. If we cannot ship on time, we will provide any delay notice, cancellation option, or refund required by applicable law. Risk of loss passes to you upon confirmed delivery to the address supplied with your order. If tracking shows delivery but you cannot locate the package, please check with household members, neighbors, the carrier, and the delivery location, and then contact us promptly through our Contact page. 7. Returns, Refunds, and Order Problems Due to health and safety considerations, dietary supplements and cosmetic products are not eligible for return or exchange. All sales are final except where a replacement or refund is required by applicable law or provided under our Return & Refund Policy. If an order arrives damaged, defective, or incorrect, contact us through our Contact page within 14 days after delivery. Include your order number and clear photographs of the product and packaging. If an order has not arrived by its estimated delivery date, contact us promptly so that we can investigate. After reviewing an eligible claim, we may provide a replacement or refund, as appropriate. Do not return or send any product to us, the manufacturer, or the fulfillment provider without prior written authorization. Additional details are provided in our Return & Refund Policy. 8. Third-Party Fulfillment and Services We use third parties, including Brand On Demand Inc., doing business as Supliful, to manufacture or source, fulfill, and ship certain products. We remain the seller for purchases made through this store. Our use of a fulfillment provider does not create a contract between you and that provider. The Services may also provide access to tools or features supplied by third parties. Such tools may be provided “as is” and “as available” and may be governed by the third party’s terms and privacy notice. We are not responsible for third-party tools except to the extent required by applicable law. 9. Relationship with Shopify This store is powered by Shopify, which enables us to provide the Services. However, purchases made through this store are made directly from Schaufert Digital. Shopify is not the seller of the products offered through this store and is not responsible for fulfilling orders, product quality, product safety, customer support, or disputes between you and Schaufert Digital, except to the extent Shopify separately assumes responsibility under its own terms or applicable law. 10. Privacy Personal information collected through the Services is handled as described in our Privacy Policy. Because the store is hosted by Shopify and orders are fulfilled by service providers, information needed to operate the store, process payments, prevent fraud, fulfill orders, provide delivery updates, and support customers may be shared with Shopify, Supliful, payment processors, carriers, and other necessary service providers. 11. Intellectual Property The Services and their content, including trademarks, trade names, logos, product names, text, graphics, photographs, videos, and design elements, are owned by or licensed to Schaufert Digital or their respective owners and are protected by applicable intellectual-property laws. You may use the Services only for personal, lawful, and non-commercial purposes. Without prior written permission, you may not reproduce, modify, distribute, publish, sell, license, scrape, commercially exploit, or create derivative works from protected content, except where such restriction is prohibited by law. Shopify and other third-party names and marks belong to their respective owners. No license to use any trademark or other intellectual property is granted except for the limited right to access and use the Services under these Terms. 12. Reviews, Feedback, and User Content If you submit a review, photograph, suggestion, or other content (“User Content”), you represent that you own or have permission to submit it, that it is accurate, and that it does not violate law or the rights of another person. You grant us a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, publish, translate, display, and distribute User Content for operating, improving, and promoting the Services. This license does not transfer ownership of your User Content to us. You must disclose any compensation, free product, discount, or other incentive received in connection with a review. We may moderate or remove User Content that is unlawful, misleading, defamatory, infringing, abusive, obscene, fraudulent, unrelated, or otherwise violates these Terms. 13. Third-Party Links The Services may contain links to websites or services operated by third parties. We do not control and are not responsible for their content, availability, security, products, practices, or privacy policies. Your use of a third-party website is governed by that third party’s terms. 14. Errors and Corrections Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, availability, shipping charges, or transit times. We may correct errors and update information at any time. If an obvious pricing or product-information error affects an order, we may contact you for instructions or cancel the affected order and provide a refund. Nothing in this section limits rights that cannot legally be excluded. 15. Disclaimer of Warranties To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. We do not guarantee that the Services will always be uninterrupted, secure, timely, or error-free. Except for express warranties stated on the product page or product label and warranties that cannot legally be excluded, we disclaim implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. Some states do not allow certain warranty exclusions. In those states, exclusions apply only to the extent permitted by applicable law. 17. Limitation of Liability To the fullest extent permitted by applicable law, Schaufert Digital and its officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, savings, data, or business opportunities, arising from or relating to the Services or these Terms. To the fullest extent permitted by applicable law, our aggregate liability arising from or relating to a particular order will not exceed the amount paid to us for that order. Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, violation of applicable product-liability law, or any other liability that cannot lawfully be excluded or limited. Because some jurisdictions do not allow certain limitations, some of the limitations above may not apply to you. 18. Indemnification To the extent permitted by law, you agree to indemnify and hold harmless Schaufert Digital and its officers, employees, contractors, and service providers from third-party claims, losses, liabilities, and reasonable legal expenses arising from your unlawful misuse of the Services, your material breach of these Terms, or your violation of another person’s rights. This section does not require a consumer to indemnify us for our own negligence, product defect, breach of law, or conduct for which indemnification cannot legally be required. 19. Suspension and Termination We may suspend or terminate access to the Services if you materially violate these Terms, misuse the Services, threaten security, or engage in suspected fraud or unlawful conduct. Termination does not affect obligations or rights that arose before termination. Provisions that by their nature should survive termination—including provisions concerning intellectual property, User Content, disclaimers, liability, indemnification, governing law, and disputes—will remain in effect. 20. Changes to the Services and Terms We may update the Services and these Terms for operational, commercial, legal, security, or regulatory reasons. The current version will be posted on this page with an updated revision date. Material changes will apply prospectively and notice will be provided when required by law. Your continued use of the Services after revised Terms become effective constitutes acceptance of those revised Terms. Changes do not retroactively alter the terms applicable to an order already accepted unless required by law or agreed with you. 21. Governing Law and Jurisdiction These Terms and contracts formed through the Services are governed by the laws of Switzerland, without regard to conflict-of-law principles. Subject to mandatory consumer-protection rights and jurisdictional rules that apply in your place of residence, the courts of the Canton of Solothurn, Switzerland, will have jurisdiction over disputes arising from or relating to the Services, an order, or these Terms. Nothing in this section deprives you of rights that cannot lawfully be waived under applicable United States federal or state law. 22. Severability If any provision of these Terms is held unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted and severed to the minimum extent necessary. The remaining provisions will remain in effect. 23. Waiver A failure or delay in enforcing a provision of these Terms is not a waiver of that provision or any other right. A waiver is effective only if made in writing by the party granting it. 24. Assignment You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, restructuring, sale of assets, transfer of the store, or similar business transaction, subject to applicable law. 25. Entire Agreement These Terms, together with the policies expressly incorporated by reference, constitute the entire agreement between you and us regarding the Services and supersede prior discussions or communications concerning the same subject matter. 26.
